Breërivier Courier – Terms & Conditions
These Terms & Conditions (T&C’s) govern the use of courier services provided by Breërivier Couriers (“we”, “us”, or “our”). By using our services, you agree to the following terms. If you do not agree with these terms, you must refrain from using our services.
1. General Terms
1.1 Breërivier Couriers offers overnight courier services across the following regions in South Africa: Skiereiland, Western-Cape, Boland, Karoo, Overberg, Suid-Kaap, Northern-Cape, Namwaland .
1.2 These T&C’s apply to all customers (individuals and businesses) using our services.
1.3 We reserve the right to modify, amend, or update these T&C’s at any time. Customers will be notified of any changes on our website.
2. Booking and Acceptance of Shipments
2.1 Customers must provide accurate, complete, and up-to-date information when booking shipments.
2.2 We reserve the right to reject any shipments that contain prohibited items or violate applicable laws.
2.3 All shipments are subject to acceptance by Breërivier Couriers based on capacity, location, and service availability.
2.4 A contract for delivery is formed once we accept the shipment and confirm receipt of the parcel.
3. Services Provided
3.1 Our overnight courier service guarantees delivery the next business day, subject to destination and other conditions.
3.2 We aim to deliver within 24 hours, but we do not guarantee delivery times unless specifically agreed upon in writing.
3.3 Delivery schedules may be affected by unforeseen circumstances such as adverse weather, traffic, or events beyond our control.
3.4 We will provide updates and tracking information for all shipments.
4. Prohibited & Restricted Items
4.1 Breërivier Couriers reserves the right to refuse or return shipments containing:
Dangerous goods or hazardous materials
Perishable items, unless specified
Illegal substances or contraband
Live animals or plants
Items that do not comply with South African postal or customs regulations
4.2 If prohibited items are shipped, the customer is fully responsible for any loss, damage, or legal action arising from it.
5. Shipping Charges & Payment
5.1 All shipping charges must be paid before dispatch unless otherwise agreed upon.
5.2 Rates are subject to change based on the size, weight, and destination of the shipment.
5.3 We accept payment via credit card, EFT, or any other method specified at the time of booking.
5.4 If payment is not made on time, Breërivier Couriers reserves the right to withhold delivery of the shipment.
6. Liability & Insurance
6.1 Breërivier Couriers is liable for damage, loss, or delay to shipments caused by negligence on our part.
6.2 Liability is limited to the lesser of the declared value of the goods or the amount outlined in the National Road Transport Law, whichever is applicable.
6.3 We strongly recommend customers obtain insurance for valuable items.
6.4 We are not liable for delays caused by external factors such as weather, traffic, strikes, or customs issues.
7. Delivery & Non-Delivery
7.1 We will make every reasonable effort to deliver shipments within the agreed timeframe.
7.2 If a recipient is unavailable at the delivery address, we will attempt to re-deliver or arrange collection, at the customer’s expense.
7.3 If the recipient refuses the shipment or the shipment is undeliverable, it will be returned to the sender, subject to additional charges.
7.4 All shipments are deemed delivered once signed for by the recipient or an authorized person at the delivery address.
8. Claims & Disputes
8.1 Any claims for lost, damaged, or delayed items must be reported to Breërivier Couriers within 7 days of delivery.
8.2 Claims must be accompanied by proof of value, receipts, or photographs of the damaged item.
8.3 Any disputes will be resolved under South African law, and any legal proceedings will take place within the jurisdiction of the relevant South African courts.
9. Customer Responsibilities
9.1 Customers are responsible for ensuring that the items being shipped are appropriately packaged and labeled.
9.2 Customers must ensure that the correct delivery details, including the address, contact information, and special instructions, are provided.
9.3 Any delay or failure in service caused by incorrect or incomplete information will not be the responsibility of Breërivier Couriers.
10. Privacy & Data Protection
10.1 Breërivier Couriers is committed to protecting the privacy of our customers. We will not disclose any personal or shipment information to third parties, except as required by law or necessary for the provision of our services.
10.2 By using our services, customers consent to the processing of their personal data in line with applicable data protection laws.
11. Force Majeure
11.1 We are not liable for any failure to perform our obligations under these terms due to causes beyond our reasonable control, including but not limited to natural disasters, war, terrorism, strikes, or other force majeure events.
12. Termination of Service
12.1 Breërivier Couriers reserves the right to terminate or suspend services for any customer who violates these T&C’s or engages in fraudulent or unlawful activity.
12.2 Upon termination, any outstanding fees must still be paid in full.
